SAN JOSE -- Two men are on trial for murder this week, after allegedly beating a man with baseball bats in downtown San Jose.
The alleged attack occurred in early 2006, and has been controversial ever since.
The victim survived the beating, but was involved in a separate police incident about an hour and a half later, where officers hit him with a baton and shot him nearly two dozen times with a Taser.
He died the next day.
The medical examiner ultimately decided the victim would have died anyway, from injuries suffered during the first beating.
Taser critics have focused on the case, arguing the police contributed to the man's death.
