Gilroy suing brand-new medical marijuana dispensary

GILROY -- In a split vote, Gilroy City Council members this week agreed to sue the owners of a brand-new medical marijuana dispensary, which opened in Gilroy without city approval.

Medical marijuana advocates packed the meeting asking the City Council to allow MediLeaf to remain open.

The dispensary had originally applied to ope, but was blocked from doing so by council members who said they needed more time to work out an ordinance regulating medical marijuana in their city. Advocates for medical marijuana say the city was simply using delay tactics.

Last week, MediLeaf opened without a business license -- arguing that as a legitimate nonprofit protected by state law, it didn't need city approval to operate.
