SILICON VALLEY -- A state Supreme Court investigation has found a prosecutor in Santa Clara county withheld evidence in a murder case tried in the 1980's.
In the stinging 39-page report, Supreme Court investigator Richard Amason found then-county prosecutor Joyce Allegro appeared to have suppressed key evidence in a 1983 murder trial.
Miguel Bacigalupo was found guilty for the killing of two men over a drug deal and is currently on Death Row at San Quentin.
Back then, Bacigalupo's defense told the court a Columbian drug lord threatened to kill him if he didn't carry out the shootings.
The report indicates Allegro had evidence supporting those claims but didn't tell the defense, which is required by law.
Allegro is currently a Santa Clara County judge and will have a chance to air her side of the story before the Supreme Court makes a decision on the report.
