Sunnyvale - The family of a man killed by Sunnyvale Department of Safety officers says he was not trying to attack investigators during a 2007 incident that left him dead. They have filed a wrongful death lawsuit.
Officers were attempting to arrest Jose Canas for a 2007 gang related murder when he was shot in front of his Sunnyvale home. Investigators say he was trying to run the officers over with his car rather than surrender, forcing the officers to shoot and kill the man.
Canas' wife disputes the claim and the suit indicates he was not fleeing from the officers at all. City officials say the officers fired the shots in self defense.
