Santa Clara - A housing development on Winchester Boulevard in San Jose could be delayed as much as a year by a court appeal of its environmental impact report.
The site, located near Valley Fair, has been controversial since the State of California decided to sell the property once known as the Bay Area Research and Extension Center, or BAREC, that was used to test pesticides.
A group fighting the development has filed a notice that it will appeal a decision by a Santa Clara Superior Court judge that the impact report complied with California law.
The housing plan calls for 165 senior units, 110 single-family homes and a one-acre park.
