MEASURE B LEGAL CHALLENGE FILED TOO LATE

A legal challenge against passage of Santa Clara County's Measure B came too late according to a Superior Court judge. He ruled that the certification of the balloting results means it's a closed matter after a court challenge got kicked out of Santa Clara County.

The State Attorney General said the lawsuit needed to be filed where they have an office. That runaround stalled proceedings just long enough for the clock to run out frustrating the nonprofit Transportation Solutions Defense and Education Fund.

Their recourse now is to agree to pay $400,000 within the next five days to fund a recount if they still insist on one.

Measure B barely passed a two-thirds majority needed to implement a one-eighth cent sales tax to help bring a BART extension to the South Bay.
