Gilroy - A two-year-old boy who was shot, then dropped off at a Gilroy hospital last week by his mother's boyfriend is improving. But police say they don't believe the man's story that the child was shot during a struggle with a rival gang member.
Amy Cornell with the District Attorney's Office says Michael Guajardo has been arraigned on one felony count of child endangerment and felony possession of a firearm with a prior firearm conviction.
Guajardo reportedly told police the boy had been shot when a member of a rival gang showed up at the house. He says a gun went off during a struggle with the bullet hitting the child.
Detectives said evidence found at the scene did not support Guajardo's story.
